A conviction carries a mandatory minimum $500 fine or at least 50 hours of community service, the one year license forfeiture, and typically the Virginia Alcohol Safety Action Program. A restricted license for school and work is possible in many cases, but it must be requested and supported properly. If the reading reaches 0.08, the charge becomes ordinary DUI under Va. Code § 18.2-266, and refusing the breath test creates its own separate violation with a year long suspension and no restricted license available for the refusal.
